Important Compliance Announcement: Personal Import Requirements for Neumi Products in Japan

 Dear Neumi Members,

We hope you are staying safe and well during the hot season in Japan.

First, we would like to express our sincere appreciation for your continued efforts to build a strong and successful Neumi business in Japan. We value your commitment and want to ensure that everyone has the information necessary to operate their business in compliance with Japanese laws and regulations.

Important Reminder Regarding Personal Imports

As you may know, Neumi products shipped to Japan are currently imported under a personal-use import framework. This import method provides certain benefits, but it also comes with important restrictions that all Members must understand and follow.

Under Japan's personal-import rules, products imported for personal use are intended for the importer's own use. They may not be sold, transferred, given to, or otherwise provided to another person. Japan's Ministry of Health, Labour and Welfare (MHLW) specifically states that products imported for personal use may not be sold or given to others.

Accordingly, Neumi products imported into Japan under the personal-import framework must not be resold or distributed to third parties.

Please also refer to Section 5 of the Gaiyou Shomen, which states that products purchased under personal import may not be sold, given, or shared with others.

Do Not Sell Neumi Products Through Online Marketplaces

We have recently become aware that Neumi products have appeared on Mercari and other online marketplaces and shopping platforms in Japan.

We understand that some of these listings may have been created unintentionally or without a full understanding of the applicable requirements. However, Members must immediately review any online listings they have created and ensure that Neumi products imported under the personal-use framework are not being offered for sale or distribution.

If you currently have Neumi products listed on Mercari or any other online marketplace, please remove those listings immediately.

This includes, but is not limited to:

• Mercari
• Online shopping marketplaces
• Buy-and-sell platforms
• Auction websites
• Social-media marketplaces
• Any other platform where products are offered for sale or distribution

Please do not create new listings or otherwise attempt to sell or distribute Neumi products imported under the personal-use framework.

Why This Is Important

Japanese authorities regulate the importation and distribution of products that may fall within the scope of pharmaceutical, health-food, or other regulated-product requirements.

MHLW explains that products imported from overseas for personal use are subject to specific restrictions and that selling or transferring personally imported products to others may violate Japan's applicable laws.

In addition, products marketed as supplements or health foods in other countries may be treated differently under Japanese law depending on their ingredients and/or the claims made about them.

For this reason, Members must not assume that a product that can legally be sold in another country can also be sold directly to consumers in Japan.

Protect Yourself and the Neumi Community

We take these requirements seriously because compliance protects you, your business, and the entire Neumi organization in Japan.

Failure to comply with Japanese laws and regulations may result in regulatory action and other legal consequences. Therefore, we strongly encourage every Member to review their current sales and marketing activities and make sure they are consistent with the personal-import requirements.

Please remember:

If a Neumi product was imported into Japan under the personal-use import framework, do not sell, resell, give away, share, or otherwise distribute that product to another person.
